When you visit this website or register for Simul8 Online, we request that you provide personal information about yourself, and we collect navigational information. Failure to provide the information may impact on our ability to deliver some or all of our services.

Personal information

As our products and services are provided on a business to business basis rather than to consumers any personal information collected from you will as far as possible be restricted to contact or user information. Personal information therefore refers to any information that you voluntarily submit to us and that identifies you personally, including contact information, such as your name, email address, company name, address, phone number, and other information about yourself or your business that is relevant to our business relationship with you and may include details of any of your employees who are authorised by you to use our products or services.

Given the nature of the products and services we sell it is extremely unlikely that we will require to collect any sensitive data about you. Where you have an account with us this will be subject to our Terms of Service and any logins or passwords you have must be kept secure and must not be disclosed to third parties which failing we will have no liability for any loss or unauthorised access to your information caused by your failure to keep such passwords or logins secure.

Our websites include social media features, such as the Facebook Like button and widgets, such as sharing buttons or interactive mini-programs that run on our sites. These features may collect your IP address, which page you are visiting on our sites, and may set a cookie to enable the feature to function properly. Social media features and widgets are either hosted by a third party or hosted directly on our websites. This Privacy Notice does not apply to these features. Our provision of such links does not constitute our endorsement of these other websites, their content, their owners, or their practices. This Privacy Notice does not apply to these other websites, which are subject to any privacy and other policies they may have.

Public forums

We offer publicly accessible blogs and message boards. Please keep in mind that if you directly disclose any information through our public message boards, blogs, or forums, this information may be collected and used by others. We will correct or delete any information you have posted on the websites if you so request, as described in "Opting out and unsubscribing" below.

Retention of personal information

How long we keep information we collect about you depends on the type of information, and this is described in further detail below. In working out how long we retain personal data we look the type of personal data involved, the purpose of processing, how sensitive or confidential the data is and at legal and commercial considerations including any legal obligations we have. By way of example by law we are required to keep accounting records for six years after end of the year in which the last transaction occurred. This means that we will be required to keep some basic customer details for that purpose even although our relationship with you may be at an end. However, it should be noted that the requirement is basic customer details and therefore it is not legitimate to also keep information such as your preferences for that period of time.

After such time, we will either delete or anonymize your information or, if this is not possible, then we will securely store your information and isolate it from any further use until deletion is possible.

We retain personal information that you provide to us where we have an ongoing legitimate business need to do so (for example, as long as is required in order to contact you about Simul8 products, services, Simul8 Online, or as needed to comply with our legal obligations, resolve disputes and enforce our agreements).

When we have no ongoing legitimate business need to process your personal information, we securely delete the information or anonymize it or, if this is not possible, then we will securely store your personal information and isolate it from any further processing until deletion is possible. We will delete this information from the servers at an earlier date if you so request, as described in "To unsubscribe from our communications" below.

If you share simulations while using Simul8 Online, you as a user, decide how long to have the simulation live on your account and who to share this with. If a user terminates their use of Simul8 Online, then we will provide the user with access to all information stored for the user by Simul8 Online, for export by the customer according to our agreement with our customer. After termination, we may, unless legally prohibited, delete all customer information, from Simul8 Online.

If you have elected to receive marketing communications from us, we retain information about your marketing preferences for a reasonable period of time from the date you last expressed interest in our content, products, or services, such as when you last opened an email from us or ceased using your Simul8 products or services.


3. How we share information we collect

We may share or disclose your personal information to the following types of third parties for the purposes described in this Privacy Notice:

Service providers

We employ other companies and people to provide services to visitors to our websites, our customers, and users of Simul8 Online and may need to share your information with them to provide information, products or services to you. Examples may include analyzing data or performing statistical analysis, providing marketing assistance, customer journey tracking and providing customer service or support. In all cases where we share your information with such agents, we explicitly require the agent to acknowledge and adhere to our privacy and customer data handling policies and to use personal information only for provision of the services to us and in a manner which is consistent with this Privacy Notice.

In addition, we may share data with trusted partners to contact you based on your request to receive such communications, help us perform statistical analysis, or provide customer support. Such third parties are prohibited from using your personal information except for these purposes, and they are required to maintain the confidentiality of your information.

Corporate events

If we (or our assets) are acquired by another company, whether by merger, acquisition, bankruptcy or otherwise, that company would receive all information gathered by Simul8 Corporation, a Minitab Company, on the websites, Simul8 Online. In this event, you will be notified via email and/or a prominent notice on our website, of any change in ownership, uses of your personal information, and choices you may have regarding your personal information.

Compelled disclosure

We reserve the right to use or disclose your personal information if required by law or if we reasonably believe that use or disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or comply with a law, court order, or legal process.


4. International transfer of information

International transfers within entities

To facilitate our global operations and dependent on where you are based, we may transfer information to either the United Kingdom or the United States and allow access to that information from countries in which the Simul8 Corporation, a Minitab Company, affiliated entities have operations but only for the purposes described in this Privacy Notice. However where possible storing and processing will take place in the region in which you are based.

This Privacy Notice shall apply even if we transfer personal information to other countries. We have taken the appropriate safeguards as required by data protection legislation to require that your personal information will remain protected.

When we share information about you within and among affiliated entities, we make use of standard contractual data protection clauses, which have been approved by the European Commission. Where we use cloud-based services or third-party providers of such services and in either or both circumstances the data is processed outside of the EEA if you are an EU based individual that will be regarded as an overseas transfer. Before instigating an overseas transfer, we will ensure that the recipient country and/or processor has security standards at least equivalent to EU standards and in particular one of the following permitted safeguards applies:

  • The country in question is deemed to have adequate safeguards in place as determined by the European Commission; or
  • There is a contract or code of conduct in place which has been approved by the European Commission which gives your personal information the same protection it would have had if it was retained within the EEA; or
  • If the overseas transfer is to the United States, then the transferee is a signatory to the EU-U.S. Data Privacy Framework (EU-U.S. DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) as set forth by the U.S. Department of Commerce as all signatories are obliged to give your personal information the same degree of protection it would have had if it was retained within the EEA.

If none of these safeguards exist, then we may seek your explicit consent for an overseas transfer. In line with your rights as an individual you are free to withdraw this consent at any time.

7. Use of Simul8 Online


Simul8 Online allows any company that uses it to build and upload simulations and relevant supporting information. The information added to Simul8 Online is stored and managed on Amazon Web Services' servers. This information is then used to understand and improve the user experience of the platform and collect usage statistics.

Use by our users

Our customers use Simul8 Online to build simulations that they can use to learn more about their business. We do not control the content of these simulations or the types of information that our users may choose to share using Simul8 Online. We process our users information as they direct and in accordance with our agreements with our users, and we store it on Amazon Web Services' servers. Our agreements with our users prohibit us from using that information, except as necessary to provide and improve Simul8 Online, as permitted by this Privacy Notice, and as required by law.
